The Wardens Court of WA, past, present and future legal challenges for mineral explorers.Warden McPhee will speak to a number of topics which have been identified as being of interest. The presentation will cover the past structure and function of the Wardens Court and its purpose, the reform work being undertaken and how that is intended to benefit the industry and the State. General information will be provided by the Warden in respect of the most relevant legal aspects of the work of the Court, as those matters are relevant to tenure disputes and exploration work, and precisely how the Wardens Court operates, within the framework of the WA legal system. Specific consideration will be given to the controversy arising from the interpretation of section 58(1)(b) of the Act, and possible future developments in that area, as well as comments on diversification leases, and the marking out requirements of the Act. The Warden is content to take questions, however notes that he is not permitted to comment on matters which are currently in dispute in his jurisdiction, or might reasonably become so. SpeakerMagistrate Thomas William McPhee Magistrate McPhee was appointed as a Magistrate on 22 October 2021. His appointment to the judiciary followed many years in practice in WA, as a commercial litigator, prosecutor and government solicitor. From his appointment to the Court, he has presided as a Perth based Mining Warden responsible for the hearing of all mining disputes within the Warden’s jurisdiction in WA. Magistrate McPhee, until recently with his colleague Magistrate Cleary (as her Honour then was), commenced and continues with a series of reforms within the Warden’s Court jurisdiction, aimed at increasing the efficiency and consistency of the application of the Mining Act in WA. Outside the law, Magistrate McPhee is a social sportsman, with particular interest in hockey, however most of his remaining energy is directed at being a decent husband and the father of young children.
